#062 Policy against the spammers of our customer

Some of NU and FM domain names are our properties. Therefore, we get considerable complaint about the Unsolicited Commercial Email (UCE) which has a from line of these domain names or which indicates web sites of these domain names. We are afraid but we never do any management of complaint about the UCE. Please ask Japan's official bureau of the UCE issue.

We reject any spam reports from any non governmental groups (such as SpamCop) or any individuals. Stop disturbing us. This is our *POLICY*;

We are an internet application service provider. However, we don't lease our equipments or lines to send e-Mail messages from our customers. To send messages, Our customers use equipments and lines of third party, or own by themselves. We're not able to control their facilities but *only ours*. We cannot violate customers' rights of sending message. Therefore we have no rule against junk mail from our customers. Imagine that an owner of a car parking space does not have responsibility to traffic offence of borrowers, also he has to stay out of their driving in a public road.

For instance, even if a malicious person send swindle UCE instead of a genuine user, we are not able to detect an actual sender. We are not able to distinguish a malicious person from a genuine user. Because we don't open the SMTP sever for the relay. We are afraid but, to retain our customers' rights, we have to refuse the request of investigation of doubtful messages. We think that it is appropriate to entrust the judgment to the public organization provided by the law. Our service is almost free, however, we are in a country under the rule of law so that it is so rude to take action against our customer without a firm evidence. We have no plan to restrict our customer's right without legal approval. And, note that your overblown (also mistaken) complaint to us turns into our nuisance or a forcible obstruction of business. In addition, remember that our customer's web site is only a *link* of ours, we are free of legal responsibility about the information provided by them.

Against the vigilance committee who performs an activity for private sanction without legal basis: (1) We regard them as the antisocial influence/organization who give a threat against order and/or security. (2) We take decisive action to them, and then intercept a relation with them entirely.
